Please read these terms carefully before commissioning me. By purchasing a commission, you agree to the following conditions.

1. PAYMENT

1.1. All payments must be made through Ko-fi.
1.2. A 50% upfront payment is required before I begin working on a commission. The remaining 50% must be paid before the final artwork is delivered.
1.3. The upfront payment covers the initial work, including sketching, planning, and the time invested in the commission.
1.4. The final, high-resolution artwork will not be delivered until the full payment has been received.

2. COPYRIGHT AND OWNERSHIP

2.1. All artwork I create is my original work, and I retain the copyright to my illustrations, including commissioned artwork and sketches.
2.2. Purchasing a commission does not mean purchasing the copyright. The client only receives permission to use the artwork as described in these terms.

3. PERMITTED PERSONAL USE

3.1. The artwork is for personal use only. Permitted uses include personal social media profiles, profile pictures, banners, wallpapers, and personal prints.
3.2. If you share the artwork on social media, proper credit is greatly appreciated. My signature must not be removed.
3.3. The artwork may not be resold, redistributed, given away, or claimed as someone else's work.
3.4. Unauthorized modifications or uses of the artwork for offensive, discriminatory, or illegal purposes are prohibited.

5. ARTIFICIAL INTELLIGENCE, NFTs, AND BLOCKCHAIN

5.1. My artwork may not be used for AI training, machine-learning datasets, AI prompts, or the generation of AI-generated content without my explicit written permission.
5.2. My artwork may not be minted as an NFT or used in NFT, blockchain, or similar projects without my explicit written permission.

6. SKETCHES, REVISIONS, AND APPROVAL

6.1. During the commission process, I may share sketches and work-in-progress previews to ensure the artwork meets your expectations.
6.3. Once the sketch has been approved, only minor adjustments may be requested. Additional changes may incur an extra fee.
6.4. The sketch is part of the commission process and is not automatically a separate deliverable.

7. CANCELLATIONS AND REFUNDS

7.1. If the client cancels after work has begun, any refund will depend on the progress made, the work already completed, and the circumstances of the cancellation.
7.2. The portion of the payment corresponding to work already completed may be retained. Any applicable refund will be communicated clearly to the client.
7.3. Once the sketch has been approved, no refund will normally be provided, as the commission has progressed beyond the initial stage. Applicable legal rights and exceptional circumstances will still be respected.
7.4. If the client cancels but wishes to keep the sketch, a separate sketch fee must be agreed upon. The sketch will only be delivered after the agreed payment has been received.
7.5. If I am unable to complete a commission, I will contact the client and refund the payment corresponding to the work not completed, subject to applicable laws and any work already delivered.

8. WORK PROCESS AND DELIVERY

8.1. Estimated completion times may vary depending on the complexity of the commission, my workload, or personal circumstances.
8.2. Completion dates are estimates rather than guarantees. I will communicate significant delays whenever possible.
8.3. Final artwork will be delivered digitally in PNG, JPG, or PDF format, depending on the commission.
8.4. Editable source files, such as PSD or AI files, are not included unless agreed upon in advance and may require an additional fee.
8.5. Unpaid final artwork will not be delivered.

9. COMMUNICATION AND INACTIVE CLIENTS

9.1. All communication must remain respectful. Abusive, threatening, or discriminatory behavior may result in the commission being cancelled.
9.2. If the client does not respond for more than 30 days, I may pause or cancel the commission after making reasonable attempts to contact them.
9.3. Any refund following inactivity or cancellation will depend on the work completed and these terms, subject to applicable laws.

10. PORTFOLIO AND PROMOTION

10.1. I reserve the right to display commissioned artwork in my portfolio, on social media, and in promotional materials to advertise my art and commission services.
10.2. If you wish to keep your commission private, you must discuss this with me before the commission begins. Privacy arrangements must be agreed upon in advance.

11. ARTIST RIGHTS AND RESPONSIBILITIES

11.1. I reserve the right to decline commissions that I am unable or unwilling to complete.
11.2. I am not responsible for unauthorized use of the artwork by third parties or problems resulting from misuse of the delivered files.
11.3. Clients are responsible for providing clear instructions and references when placing an order.

12. ACCEPTANCE OF TERMS

By placing an order through Ko-fi, you confirm that you have read, understood, and agreed to these terms.
